This Privacy and Cookies Policy (hereinafter referred to as the "Privacy Policy") applies to the processing of personal data in the services provided by INSTASENT MOBILE ADVERTISING, S.L. (hereinafter referred to as "INSTASENT") to its clients and users of this website. INSTASENT provides access to its platform, where it offers its clients the possibility to manage their customer databases according to their needs and provide value-added services (mass SMS, HPLookup, and other services offered on its platform).
Please note that before using any of our services or features, you must read and accept this Privacy Policy.
This Privacy Policy applies to the processing of personal data in general, except as provided in the Data Processing Annex included in the General Terms and Conditions agreement, which specifically regulates the processing carried out by Instasent as Data Processor on behalf of the Client.
In the event of any conflict between the provisions of this Privacy Policy and those of the Data Processing Annex, the provisions of the Annex shall prevail in relation to the processing of the Client's Personal Data.
Likewise, it regulates how we use personal data, the reasons why we share personal data and how you can access and control them.
1.- Processing of Personal Data.
In accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and Regulation (EU) 2016/679 on data protection (hereinafter "GDPR"), INSTASENT will process the personal data collected through contact forms, service contracting, or any other means related to the website. The personal data collected provided by INSTASENT's client(s) (hereinafter "the Client/s") will be treated with absolute confidentiality and in accordance with the duty of secrecy.
Similarly, INSTASENT informs its Clients that the personal data collected will be stored in a register of processing activities that is the exclusive property of INSTASENT. INSTASENT has implemented appropriate technical and organizational measures to ensure the security of your personal data and prevent such data from being destroyed, lost, unlawful, or unlawfully altered. When determining these measures, INSTASENT has considered the scope, context, and purpose of the processing; the current state of technology, and the risks involved in order to develop such measures.
INSTASENT will also access the databases of the clients that you share on the platform for the purpose of providing services. As such, INSTASENT will be the data processor for that personal data. Your clients' personal data will be treated with absolute confidentiality and in compliance with the duty of secrecy. The data controller for this data is the Client who contracts the services provided by INSTASENT.
Consequently, the legitimate basis for processing your data by the data controller is the consent of the clients, while the legitimate basis for the processing by INSTASENT is the execution of the contract.
Below, we explain what personal data we have access to while the contract between INSTASENT and the Client is in force:
- Identifying data that you provide in the contact form or when contracting with us (name, email address, phone number).
- Economic and transactional data (e.g., payment data or credit card).
- IP address.
The personal data will be stored to fulfill the purposes mentioned below. Once your consent is revoked or the contract has ended, INSTASENT will keep the personal data duly blocked for a period of 5 years solely for the purpose of addressing any liability that may arise. Once such liabilities have become statute-barred, the personal data provided to INSTASENT will be deleted.
2. Purposes of Data Processing
In compliance with the principles of privacy by design, privacy by default, and data minimization, INSTASENT will only collect personal data that is necessary to achieve the purposes outlined below. The personal data collected through the website is relevant, adequate, and not excessive for these purposes. INSTASENT does not use illegal, unfair, or fraudulent procedures to obtain personal data.
The primary purpose for which INSTASENT collects personal data is to provide information about the services or clients accessing INSTASENT's website for consultation: (i) additional generic information related to INSTASENT; (ii) specific information related to the Client's own activity; (iii) to manage the contract you have with us, or (iv) to administer the payment for services you contract with us. Similarly, if the Client gives express consent, INSTASENT may process their data to send informative communications related to INSTASENT's activity, offers, events, and future services. These communications may be sent via email. Without the Client's consent, no communications or proposals will be sent.
INSTASENT will request the Client's prior consent each time their data is used for a purpose different from the one provided or requested.
3.- Rights Clients Can Exercise Against INSTASENT
Any Client wishing to exercise their rights of access, rectification, deletion, opposition, portability, and limitation must notify INSTASENT through the following means by submitting an explicit request, along with a copy of their ID card or similar document in the case of legal entities:

These requests can be exercised free of charge and will be processed by INSTASENT as soon as possible, within a maximum period of 30 days from the date the rights were exercised. INSTASENT informs that this period may be extended to a maximum of 90 days with a valid justification.
In accordance with current regulations on the protection of personal data, the Client may exercise the following rights against INSTASENT:
- Right of access: The Client can request that INSTASENT disclose which data related to them are being processed by INSTASENT, as well as the source from which the data were collected and the purpose for which the data are processed.
- Right of rectification: The Client can request that INSTASENT modify any personal data that is not up to date.
- Right of deletion: The Client can request that INSTASENT delete their personal data unless there are valid and justifiable reasons that allow INSTASENT to retain the data. The right of deletion involves a period during which personal data will remain blocked before final deletion, both to comply with any legal obligations that may arise and to address potential administrative or jurisdictional liabilities.
- Right of objection: The Client can object to the use of their personal data for certain purposes.
- Right to limit processing: The Client can request that INSTASENT limit the processing of their data for certain purposes.
- Right to data portability: The Client can request that INSTASENT provide them with the information that INSTASENT holds in a structured, commonly used, and machine-readable format.
Clients are also informed of their right to lodge a complaint with the relevant supervisory authority. In the event of disagreement with how INSTASENT collects and processes personal data or the way in which requests to exercise the rights provided here are handled, Clients can file a complaint with the supervisory authority (Spanish Data Protection Agency and other competent public bodies).
4. Disclosure of Data to Third Parties
INSTASENT commits not to transfer or disclose the Client's personal data to any third party unless the Client explicitly authorizes it in advance.
However, it is possible that INSTASENT may allow access to the Client's personal data to third parties providing a relevant service to the Client. These third parties will be considered data processors. As such, they can only process the Client's personal data in accordance with INSTASENT's instructions. Under no circumstances will data processors use the Client's personal data for purposes other than those detailed in section 2 of this Privacy Policy.
INSTASENT requires all individuals or legal entities with whom it shares information containing personal data to apply the same level of information protection.
5.- Third-Party Links
INSTASENT does not recommend the use, nor does it guarantee that the information and content provided by third-party websites or links accessed through hyperlinks (and vice versa) is complete, correct, and truthful. Similarly, INSTASENT is not responsible for the use of third-party websites.
INSTASENT has no control over, nor does it assume any responsibility for, the content, privacy conditions, or practices of third-party sites or services.
6.- Social Media
INSTASENT may have a presence on social media. The processing of data carried out on individuals who become followers on social media (and/or carry out any link or connection action through social media) of INSTASENT's official pages will be governed by this section, as well as by the terms of use, privacy policies, and access regulations applicable to the relevant social network, which were previously accepted by the user.
INSTASENT will process personal data for the purpose of properly managing its presence on social media, informing about activities, products, or services of the provider, as well as for any other purpose that the social media regulations may allow.
- The publication of content that is allegedly illegal according to national, community, or international regulations, or that engages in allegedly illegal activities or contravenes principles of good faith, is prohibited.
- Content that violates the fundamental rights of individuals, lacks courtesy on the network, is annoying, or may generate negative opinions among our users or third parties, and in general, any content that INSTASENT considers inappropriate is also prohibited.
- -And in general, that contravene the principles of legality, honesty, responsibility, protection of human dignity, protection of minors, protection of public order, protection of privacy, protection of consumers, and intellectual and industrial property rights
INSTASENT reserves the right to remove, without prior notice, from the website or corporate social network those contents that are considered inappropriate.
Communications sent through social networks will be included in a file owned by INSTASENT. In any case, if the user sends personal information through the social network, INSTASENT will be exempt from responsibility regarding the security measures applicable in the corresponding social network. If the user wants to know them, they should consult the corresponding particular conditions of the relevant network.
7.- Cookies
This website uses its own cookies and third-party cookies that are necessary to allow the Client to enjoy all the functionalities of the website, as well as to monitor and track the client's activity on the website. However, INSTASENT informs you that some of the functions of its website require the installation of cookies for proper operation.
